Forgery of Documents (Turkish Penal Code Arts. 204-209)
Evrakta sahtecilik; resmi belgede sahtecilik, özel belgede sahtecilik, resmi belgenin düzenlenmesinde yalan beyan ve açığa imzanın kötüye kullanılması olmak üzere dört ayrı suç tipi olarak düzenlenmiştir.
Resmi Belgede Sahtecilik (TCK m.204)
Resmi belge, bir kamu görevlisinin görevi gereği ve kanunda belirtilen usule göre düzenlediği belgedir. Bu koşulları taşımayan belge, diğer şartlar varsa özel belgede sahtecilik suçuna konu olabilir.
Failin kamu görevlisi olup olmamasına göre ikili ayrıma gidilmiş; kamu görevlisi için daha ağır ceza öngörülmüştür. Doktrinde "fikri sahtecilik" olarak adlandırılan, tüm şekil şartlarıyla geçerli olmakla birlikte içeriği gerçeğe aykırı resmi belge düzenlenmesi (m.204/2) yalnızca kamu görevlisi tarafından işlenebilir. Kamu görevlisi olan ve olmayan kişiler birlikte resmi belgede sahtecilik işlerse, her ikisi de daha ağır olan m.204/2'den sorumlu olur; kamu görevlisi olmayan kişi azmettiren veya yardım eden olarak değerlendirilir.
Özel Belgede Sahtecilik (TCK m.207)
Özel belgede sahtecilik suçunun faili herkes olabilir; kamu görevlisi ayrımı yapılmaz. Resmi belgeden farklı olarak burada belgenin sahte düzenlenmesi/değiştirilmesi ve kullanılması birlikte aranır. Kullanılmayan sahte özel belge suç oluşturmaz.
Resmî Belgenin Düzenlenmesinde Yalan Beyan (TCK m.206)
Bu suç, kamu görevlisinin fikri sahteciliğine benzer; ancak burada gerçeğe aykırı belgeyi kamu görevlisi değil, beyanıyla kamu görevlisini yanıltan kişi dolaylı olarak oluşturur.
Açığa İmzanın Kötüye Kullanılması (TCK m.209)
Belirli bir biçimde doldurulmak üzere teslim edilen, henüz belge niteliği taşımayan imzalı boş kâğıdın, verenin iradesine aykırı doldurularak belge hâline getirilmesidir. Burada belirleyici unsur, imzalı kâğıdın rıza ile verilmiş olması; ancak veriliş amacına aykırı kullanılmasıdır. İmzalı kâğıt hukuka aykırı yolla ele geçirilmişse, koşulları varsa belgede sahtecilik hükümleri uygulanır.
Diğer Hususlar
Özel belgede sahtecilik suçunun; emre veya hamile yazılı kambiyo senedi, emtiayı temsil eden belge, hisse senedi, tahvil veya vasiyetname üzerinde işlenmesi hâlinde, bu belgeler resmi belge niteliği taşımasa da fail resmi belgede sahtecilik hükümlerine göre cezalandırılır (TCK m.210/1). Ayrıca sahtecilik suçunun bir hukuki ilişkiye dayanan alacağın ispatı veya gerçek bir durumun belgelenmesi amacıyla işlenmesi hâlinde, verilecek ceza yarısı oranında indirilebilir (TCK m.211).
Forgery of documents is regulated as four separate offences: forgery of a public document, forgery of a private document, false declaration in the drawing up of a public document, and misuse of a signed blank page.
Forgery of a Public Document (Turkish Penal Code Art. 204)
A public document is one drawn up by a public official in the course of their duties and in accordance with the procedure prescribed by law. A document that does not meet these conditions may, if the other requirements are present, constitute the offence of forgery of a private document.
The law draws a distinction according to whether or not the perpetrator is a public official, prescribing a heavier penalty for public officials. What is termed "ideological (intellectual) forgery" in legal doctrine — the drawing up of a public document that satisfies all formal requirements but whose content is contrary to the truth (Art. 204/2) — can be committed only by a public official. Where a public official and a non-official jointly commit forgery of a public document, both are held liable under the more severe Art. 204/2, with the non-official being treated as an instigator or aider.
Forgery of a Private Document (Turkish Penal Code Art. 207)
The offence of forgery of a private document may be committed by anyone; no distinction is made for public officials. Unlike forgery of a public document, here the forging or altering of the document and its use are required together. A forged private document that is not used does not constitute the offence.
False Declaration in the Drawing Up of a Public Document (Turkish Penal Code Art. 206)
This offence resembles the ideological forgery committed by a public official; here, however, the untrue document is created not by the public official but indirectly by the person who misleads the public official through their declaration.
Misuse of a Signed Blank Page (Turkish Penal Code Art. 209)
This consists in turning into a document — by filling it out contrary to the will of the person who provided it — a signed blank page that was handed over to be completed in a specific manner and that does not yet have the character of a document. The decisive element here is that the signed page was provided with consent, yet used contrary to the purpose for which it was provided. If the signed page was obtained by unlawful means, the provisions on forgery of documents apply where their conditions are met.
Other Matters
Where the offence of forgery of a private document is committed on a bill of exchange payable to order or to bearer, a document representing goods, a share certificate, a bond, or a will, the perpetrator is punished under the provisions on forgery of a public document, even though these documents do not have the character of public documents (Turkish Penal Code Art. 210/1). Furthermore, where the offence of forgery is committed for the purpose of proving a claim arising from a legal relationship or of documenting a genuine situation, the penalty imposed may be reduced by one half (Turkish Penal Code Art. 211).
