Requirements for Obtaining a Residence Permit under Turkish Law and Recent Developments in Practice
Uluslararası göç hareketlerinin artmasıyla, yabancıların Türkiye'de yasal kalışını düzenleyen ikamet izni uygulamaları büyük önem kazanmıştır. İzinler, 6458 sayılı YUKK kapsamında düzenlenir.
Özet
Türkiye'nin jeopolitik konumu ve ekonomik potansiyeli nedeniyle her yıl yüz binlerce yabancı ikamet izni başvurusunda bulunmaktadır. İkamet izinleri, 6458 sayılı Yabancılar ve Uluslararası Koruma Kanunu (YUKK) kapsamında düzenlenir ve yabancıların Türkiye'de hukuka uygun kalabilmesinin temel şartını oluşturur. Bu çalışmada ikamet izni türleri, başvuru şartları, ret nedenleri ve güncel uygulama sorunları incelenmektedir.

I. Giriş
Devletlerin egemenlik yetkisinin doğal sonucu olarak yabancıların ülkeye girişi, kalışı ve çıkışı belirli kurallara bağlanır. Türkiye'de yabancıların ikamet rejimi esas olarak YUKK ile düzenlenmiştir. Vize veya vize muafiyetiyle giriş yapan yabancılar, bu sürelerin ötesinde kalmak isterse kural olarak ikamet izni almak zorundadır.
II. İkamet İzninin Hukuki Niteliği
İkamet izni; yabancının, vize veya vize muafiyet süresinden daha uzun süre Türkiye'de kalabilmesini sağlayan resmi bir izindir. Bu izin yasal kalış hakkı sağlar, kamu hizmetlerinden yararlanmayı ve idari işlemleri kolaylaştırır.
III. İkamet İzni Türleri
En yaygın türdür. Başlıca veriliş amaçları: taşınmaz sahibi olmak, ticari bağlantı/iş kurmak, bilimsel araştırma, turizm, tedavi, Türkçe öğrenmek ve eğitim programlarına katılmak. Kısa dönem izinleri kural olarak azami ikişer yıllık sürelerle düzenlenir.
Türk vatandaşlarının veya Türkiye'de yasal bulunan yabancıların eşi, ergin olmayan çocukları ve bağımlı çocukları aile ikamet izni alabilir. Her seferinde en fazla üç yıl süreyle düzenlenir.
Türkiye'deki bir yükseköğretim kurumunda ön lisans, lisans, yüksek lisans veya doktora eğitimi gören yabancılar öğrenci ikamet izni alır; izin eğitim süresi boyunca sürer.
Türkiye'de kesintisiz en az sekiz yıl ikamet etmiş yabancılar, belirli şartları sağlamaları hâlinde süresiz uzun dönem ikamet izni alabilir. Bu izin, yabancıya vatandaşlığa yakın birçok hak tanır (sosyal güvenlik, eğitim vb.).
İstisnai ve özel durumlarda verilir: çocuğun üstün yararı, olağanüstü insani nedenler veya sınır dışı kararının uygulanamaması gibi hâllerde başvurulur.

V. Başvuruların Reddedilme Nedenleri
Göç İdaresi Başkanlığı'nın incelemesi sonucunda başvurular reddedilebilir. Başlıca ret gerekçeleri:
Son yıllarda özellikle "turistik/kısa dönem" başvurularda daha sıkı değerlendirme yapıldığı; Göç İdaresi'nin bazı il ve mahallelerde yabancı yoğunluğu nedeniyle yeni kayıtları sınırlandırdığı görülmektedir.
VI. İkamet İzninin İptali ve Uzatılması
İzin sahibi yabancıların, süre dolmadan (kural olarak bitiş tarihinden geriye 60 gün içinde) uzatma başvurusu yapması gerekir. Ayrıca; ikamet amacının ortadan kalkması, sahte belge kullanılması, yıl içinde kanunda öngörülen süreyi aşacak şekilde Türkiye dışında kalınması veya kamu düzenine aykırı faaliyetler hâlinde izinler iptal edilebilir.
VII. İdari Yargı Yolu ve Hukuki Koruma
Başvurunun reddi hâlinde yabancının hukuki koruma yollarına başvurması mümkündür: idari itiraz, iptal davası ve yürütmenin durdurulması talebi gündeme gelebilir. İdare mahkemeleri, Göç İdaresi kararlarının hukuka uygunluğunu denetler. Danıştay ve bölge idare mahkemesi kararlarında özellikle ölçülülük ilkesi ve aile hayatına saygı hakkı (AİHS m.8) dikkate alınmaktadır.
VIII. Sonuç
Türkiye, son yıllarda uluslararası göç hareketlerinin merkezindeki ülkelerden biri hâline gelmiştir; bu durum ikamet izni uygulamalarının önemini artırmıştır. Yabancıların hukuka uygun kalabilmesi için başvurularını eksiksiz ve doğru belgelerle yapması büyük önem taşır. Uygulamada kamu düzeni, mali yeterlilik ve gerçek ikamet amacı kriterleri belirleyici rol oynamaktadır. Önümüzdeki dönemde dijital başvuru sistemlerinin geliştirilmesi, uygulama birliğinin sağlanması ve hak arama yollarının güçlendirilmesi, Türk yabancılar hukukunun temel gündem başlıkları arasında yer almaya devam edecektir.
With the rise in international migration, residence permit practices governing foreigners' lawful stay in Türkiye have become highly important. Permits are governed by Law No. 6458 (LFIP).

Owing to Türkiye's geopolitical position and economic potential, hundreds of thousands of foreigners apply for a residence permit each year. Residence permits are governed by Law No. 6458 on Foreigners and International Protection (LFIP) and constitute the fundamental requirement for foreigners to remain lawfully in Türkiye. This study examines the types of residence permit, the application requirements, the grounds for refusal, and current issues in practice.

I. Introduction
As a natural consequence of the sovereign authority of States, the entry, stay, and exit of foreigners are subject to specific rules. In Türkiye, the residence regime for foreigners is primarily governed by the LFIP. Foreigners who enter with a visa or under a visa exemption must, as a rule, obtain a residence permit if they wish to remain beyond those periods.
II. The Legal Nature of the Residence Permit
A residence permit is an official authorization enabling a foreigner to remain in Türkiye for longer than the visa or visa-exemption period. It confers a right of lawful stay and facilitates access to public services and administrative procedures.
III. Types of Residence Permit
This is the most common type. Its principal purposes of issuance include: owning immovable property, establishing a commercial connection or business, scientific research, tourism, medical treatment, learning Turkish, and participating in educational programs. Short-term permits are, as a rule, issued for periods of up to two years at a time.
The spouse, minor children, and dependent children of Turkish citizens or of foreigners lawfully present in Türkiye may obtain a family residence permit. It is issued for a maximum of three years at a time.
Foreigners pursuing associate, undergraduate, master's, or doctoral studies at a higher education institution in Türkiye obtain a student residence permit, which lasts for the duration of the education.
Foreigners who have resided in Türkiye continuously for at least eight years may, provided they meet certain conditions, obtain an indefinite-term long-term residence permit. This permit grants the foreigner many rights close to those of citizenship (social security, education, etc.).
It is granted in exceptional and special circumstances, such as the best interests of the child, extraordinary humanitarian reasons, or where a deportation decision cannot be enforced.

In recent years, a stricter assessment has been observed particularly in "tourism/short-term" applications, and the Migration Management authority has restricted new registrations in certain provinces and neighborhoods due to the concentration of foreigners.
VI. Revocation and Extension of the Residence Permit
Permit holders must apply for an extension before the permit expires (as a rule, within 60 days prior to the expiry date). In addition, permits may be revoked where the purpose of residence ceases to exist, forged documents are used, the holder remains outside Türkiye for longer than the period prescribed by law within a year, or activities contrary to public order are carried out.
VII. Recourse to Administrative Courts and Legal Protection
Where an application is refused, the foreigner may resort to legal remedies: an administrative objection, an action for annulment, and a request for a stay of execution may come into play. Administrative courts review the lawfulness of the decisions of the Migration Management authority. In the decisions of the Council of State and the regional administrative courts, the principle of proportionality and the right to respect for family life (Article 8 of the ECHR) are given particular consideration.

In recent years, Türkiye has become one of the countries at the center of international migration movements, which has increased the importance of residence permit practices. In order for foreigners to remain lawfully, it is of great importance that they submit their applications complete and with accurate documents. In practice, the criteria of public order, financial sufficiency, and genuine purpose of residence play a decisive role. In the coming period, the development of digital application systems, the achievement of uniformity in practice, and the strengthening of avenues for seeking justice will continue to be among the principal items on the agenda of Turkish immigration law.
