İnternette yer alan kişilik haklarını ihlal eden veya özel hayatın gizliliğini zedeleyen içeriklere karşı 5651 sayılı Kanun çeşitli koruma mekanizmaları öngörmektedir. Ayrıca “unutulma hakkı”, geçmişte yaşanmış ve güncelliğini yitirmiş haberlerin arama sonuçlarından çıkarılmasını talep etme imkânı tanır.
İçeriğin Kaldırılması ve Erişimin Engellenmesi
Kişilik hakları ihlal edilen kişiler, 5651 sayılı Kanun m.9 uyarınca içeriğin çıkarılması veya erişimin engellenmesi için sulh ceza hâkimliğine başvurabilir. Hâkimlik başvuruyu en geç 24 saat içinde duruşma yapmaksızın karara bağlar. Özel hayatın gizliliğinin ihlali hâlinde ise doğrudan kuruma başvuru yolu da düzenlenmiştir.
Unutulma Hakkı
Unutulma hakkı; haberin güncelliğini yitirmesi, kamu yararının ortadan kalkması, kişinin kamuya mal olmuş biri olmaması ve içeriğin kişiyi damgalayıcı nitelik taşıması gibi kriterler çerçevesinde değerlendirilir. Anayasa Mahkemesi ve Yargıtay kararlarıyla şekillenen bu hak, KVKK kapsamındaki silme ve yok etme talepleriyle de desteklenebilir.
Arama Motorlarından İçerik Kaldırma
Arama motorlarına doğrudan başvuru yapılarak sonuçların kaldırılması talep edilebilir; reddedilmesi hâlinde Kişisel Verileri Koruma Kurulu'na ve yargı yoluna başvurulabilir.
Tazminat İmkânı
Hukuka aykırı içerik nedeniyle kişilik hakları ihlal edilenler, içeriği üreten ve yayan kişilere karşı manevi tazminat davası açabilir; içerik suç oluşturuyorsa cezai şikâyet hakkı da saklıdır.

Persons whose personal rights are infringed may, pursuant to Article 9 of Law No. 5651, apply to the criminal judgeship of peace for the removal of the content or the blocking of access. Where the privacy of private life is violated, a direct application to the Authority is also provided for.
The Right to Be Forgotten
The right to be forgotten is assessed within the framework of criteria such as the news report having lost its currency, the disappearance of the public interest, the person not being a public figure, and the content being stigmatizing for the individual. Shaped by the decisions of the Constitutional Court and the Court of Cassation, this right may also be reinforced by requests for erasure and destruction under the KVKK (Personal Data Protection Law).
Delisting Content from Search Engines
An application may be made directly to search engines requesting the removal of results; if it is rejected, recourse may be had to the Personal Data Protection Board and to judicial remedies.
Availability of Compensation
Those whose personal rights are infringed by unlawful content may file an action for non-pecuniary (moral) damages against the persons who create and disseminate the content; where the content constitutes an offense, the right to file a criminal complaint is also reserved.
