Name (First Name/Surname) Change Action
Nüfusta kayıtlı ad ve soyadın değiştirilmesi, Türk Medeni Kanunu m.27 uyarınca ancak haklı sebeplerin varlığı hâlinde ve mahkeme kararıyla mümkündür. Belirli düzeltmeler ise idari yolla yapılabilir.
Görevli ve Yetkili Mahkeme
Ad ve soyad değişikliği davasında görevli mahkeme asliye hukuk mahkemesi, yetkili mahkeme ise yerleşim yerinizin (ikametgâhınızın) bulunduğu yer mahkemesidir (Nüfus Hizmetleri Kanunu m.36). Davayı yerleşim yerinizdeki asliye hukuk mahkemesinde açabilirsiniz. Davalı taraf ilgili nüfus müdürlüğüdür.
Haklı Sebep Şartı (TMK m.27)
Mahkeme yalnızca haklı sebebe dayanan talepleri kabul eder. Uygulamada en çok kabul gören haklı sebepler şunlardır:
Kişiye nüfustaki isminden farklı bir isimle hitap edilmesi ve bu isimle çevresinde tanınması (en yaygın gerekçe); ismin alay konusu olacak nitelikte olması; ismin millî kültüre, örf-âdet ve geleneklere uygun olmaması; ismin, kişisel ilişkilerde veya meslek/sanat icrasında yanlış anlaşılmalara yol açması.
Dava Süreci ve Dilekçe
İsim değiştirme dilekçesi asliye hukuk mahkemesine hitaben yazılır. Ad, soyad, T.C. kimlik no ve adres gibi kişisel bilgilerin ardından değişiklik gerekçesi açıklanır; dinletilmek istenen tanıkların ad ve adresleri dilekçeye eklenir. Bu davada tanık beyanları son derece önemlidir; gerekçeyi destekleyen tanıklar mahkemece dinlenir.
Mahkeme ayrıca, talebin bir takım yükümlülüklerden kaçma amacı taşıyıp taşımadığını araştırmak için kolluk güçlerinden kişinin aranıp aranmadığına dair bilgi alır. İsim değişikliği tüm resmî kurumlar nezdinde kimlik bilgisini etkilediğinden bu inceleme yapılır. Mahkemelerin yoğunluğuna göre dava genellikle yaklaşık 2-3 ayda sonuçlanabilir. Karar kesinleştikten sonra değişiklik nüfus müdürlüğüne bildirilir; tarafların istinaf/temyiz haklarından feragat dilekçesi vermesi süreci hızlandırabilir.
İdari Yolla Değişiklik İmkânı
Under Article 27 of the Turkish Civil Code (TCC), changing a first name and surname recorded in the civil registry is possible only where just cause exists and by a court decision. Certain corrections, however, may be made through administrative channels.
Competent and Jurisdictional Court
In an action to change a first name and surname, the competent court is the civil court of first instance, and the court with jurisdiction is the court of the place of your domicile (residence) (Article 36 of the Civil Registry Services Law). You may bring the action before the civil court of first instance at your place of residence. The defendant party is the relevant civil registry directorate.
The Just Cause Requirement (TCC Art. 27)
The court accepts only claims based on just cause. In practice, the most commonly accepted grounds of just cause are the following:
The person being addressed by a name different from the one recorded in the civil registry and being known in their community by that name (the most frequent ground); the name being of a nature liable to provoke ridicule; the name not conforming to national culture, custom, and tradition; and the name giving rise to misunderstandings in personal relationships or in the practice of a profession or art.
The Court Process and the Petition
The name-change petition is addressed to the civil court of first instance. After personal details such as the first name, surname, Turkish ID number, and address, the grounds for the change are set out; the names and addresses of the witnesses to be heard are appended to the petition. In this action, witness statements are of the utmost importance; witnesses supporting the grounds are heard by the court.
The court also obtains information from law enforcement as to whether the person is wanted, in order to investigate whether the request is aimed at evading certain obligations. This inquiry is conducted because a name change affects the person's identity information before all official institutions. Depending on the caseload of the courts, the action can generally be concluded in approximately 2-3 months. Once the decision becomes final, the change is notified to the civil registry directorate; the parties' filing a waiver of their rights to appeal (istinaf/temyiz) can expedite the process.
