Kamulaştırma, idarenin kamu yararı amacıyla özel mülkiyetteki taşınmazlara bedelini ödeyerek el koymasıdır ve 2942 sayılı Kamulaştırma Kanunu'nda düzenlenmiştir. İdarenin usule uymadan taşınmaza fiilen veya hukuken el atması hâlinde ise “kamulaştırmasız el atma” söz konusu olur.

Kamulaştırma Süreci

İdare önce kamu yararı kararı alır, taşınmazın tahmini bedelini belirler ve malikle satın alma usulünü dener. Anlaşma sağlanamazsa idare, asliye hukuk mahkemesinde bedel tespiti ve tescil davası açar. Mahkemece bilirkişi incelemesiyle belirlenen bedel peşin ödenmek suretiyle taşınmaz idare adına tescil edilir.

Kamulaştırma Bedeline İtiraz

Malik, tebliğ edilen kamulaştırma işlemine karşı 30 gün içinde idari yargıda iptal davası açabilir; bedelin düşük belirlendiği iddiası ise bedel tespiti davasında ileri sürülür. Bedel; taşınmazın cinsi, yüzölçümü, imar durumu, emsal satışlar ve gelir metodu gibi kriterlere göre belirlenir.

Kamulaştırmasız El Atma

İdarenin kamulaştırma yapmaksızın taşınmazı fiilen kullanması (yol, park, enerji hattı geçirilmesi vb.) fiilî el atma; imar planlarıyla taşınmazın kullanımının uzun süre kısıtlanması ise hukuki el atma olarak adlandırılır. Malik, taşınmaz bedelinin tahsili için dava açabileceği gibi müdahalenin men'ini ve ecrimisil de talep edebilir.

Zamanaşımı ve Süreler

Kamulaştırmasız el atma davalarında bedel talepleri yönünden mülkiyet hakkının niteliği gereği geniş bir koruma söz konusudur; ancak somut olaya göre süre ve usul değerlendirmesi mutlaka yapılmalıdır.

Expropriation is the taking of privately owned immovable property by the administration for reasons of public interest against payment of its value, and it is governed by the Expropriation Law No. 2942. Where the administration takes possession of immovable property, either physically or legally, without complying with the required procedure, this gives rise to what is known as “de facto expropriation” (expropriation without lawful proceedings).

The Expropriation Process

The administration first adopts a public-interest decision, determines the estimated value of the immovable property, and attempts to acquire it from the owner through a purchase procedure. If no agreement is reached, the administration files an action before the civil court of first instance for the determination of the compensation and for registration. The value determined by the court on the basis of an expert examination is paid in advance, and the immovable property is registered in the name of the administration.

Objecting to the Expropriation Compensation

The owner may bring an action for annulment before the administrative courts within 30 days against the expropriation act that has been served on them; a claim that the compensation has been set too low, however, is raised in the compensation-determination action. The value is determined according to criteria such as the type, area, and zoning status of the immovable property, comparable sales, and the income method.

De Facto Expropriation (Unlawful Taking)

The administration's physical use of immovable property without carrying out expropriation (such as running a road, park, or power line through it) constitutes physical taking, whereas the long-term restriction of the property's use through zoning plans is referred to as legal taking. The owner may bring an action to recover the value of the immovable property, and may also seek the prevention of the interference (removal of encroachment) and mesne profits (ecrimisil).

Statute of Limitations and Time Limits

In de facto expropriation claims, extensive protection applies to compensation claims by virtue of the nature of the right of property; nevertheless, an assessment of the applicable time limits and procedure must always be made in light of the specific facts.

Conclusion

In expropriation cases, determining the compensation on the basis of the true value largely depends on effective objections to the expert reports. For this reason, it is in the owner's interest to have the process conducted by a specialist lawyer.
