Kimler Konkordato Talep Edebilir?

Başvuru ve Gerekli Belgeler
Başvuru, borçlunun merkezinin bulunduğu yerdeki asliye ticaret mahkemesine yapılır. Başvuruya konkordato ön projesi, ayrıntılı bilanço, gelir tablosu, alacaklı ve alacak listesi ile bağımsız denetim kuruluşunca hazırlanan makul güvence raporu eklenir.
Konkordato Projesinin Kabulü ve Tasdiki

Composition (concordat) is an institution regulated under the Enforcement and Bankruptcy Law that enables debtors who cannot pay their debts as they fall due, or who are at risk of being unable to do so, to restructure their debts by reaching an agreement with their creditors. For companies seeking to avoid the severe consequences of bankruptcy, it is an important instrument of legal protection.
Who May Apply for Composition?
Any debtor, whether or not subject to bankruptcy, may apply for composition; in practice, commercial companies are the most frequent applicants. In addition, creditors may request the commencement of composition proceedings against debtors in respect of whom they would be entitled to file for bankruptcy.
Application and Required Documents
The application is filed with the commercial court of first instance at the place where the debtor's head office is located. The application must be accompanied by the preliminary composition plan, a detailed balance sheet, an income statement, a list of creditors and claims, and a reasonable assurance report prepared by an independent audit firm.
Acceptance and Ratification of the Composition Plan
If the composition plan is accepted by the majority of creditors and claims prescribed by law, it becomes binding upon ratification by the court. A ratified composition is valid for all ordinary creditors, including those who voted against the plan.
Strategic Importance for Companies
When properly planned, composition allows a company to continue its operations while paying off its debts; a mismanaged process, however, may result in bankruptcy. Preparing the preliminary plan realistically and conducting the process through the cooperation of a certified public accountant and a lawyer are of critical importance.
