Mobbing (Psychological Harassment in the Workplace): Legal Remedies
Mobbing; işyerinde bir çalışana yönelik sistematik biçimde tekrarlanan yıldırma, dışlama, aşağılama ve baskı davranışlarını ifade eder. Türk Borçlar Kanunu m.417, işverene işçinin kişiliğini koruma ve işyerinde psikolojik tacizi önleme yükümlülüğü getirmiştir.
Hangi Davranışlar Mobbing Sayılır?
Sürekli ve sistematik olarak; görev tanımı dışında veya niteliksiz işler verilmesi, performansın haksız şekilde sürekli eleştirilmesi, çalışanın iş arkadaşlarından izole edilmesi, hakaret ve küçük düşürücü davranışlar, görev yerinin sürekli ve keyfi değiştirilmesi mobbing kapsamında değerlendirilebilir. Tek seferlik anlaşmazlıklar veya işverenin olağan yönetim hakkı kapsamındaki uygulamalar mobbing sayılmaz; süreklilik ve kasıt unsuru aranır.
Mobbingin İspatı
Mobbing davalarında ispat en kritik aşamadır. E-posta ve yazışma kayıtları, görev değişikliği yazıları, tanık beyanları, doktor ve psikolog raporları, tutanaklar delil olarak kullanılabilir. Yargıtay, mobbing iddialarında kesin delil aranmayacağını, emarelerin yeterli olabileceğini kabul etmektedir.
Çalışanın Hakları
Mobbinge maruz kalan işçi; iş sözleşmesini İK m.24 uyarınca haklı nedenle feshederek kıdem tazminatını talep edebilir, manevi tazminat ve koşulları varsa maddi tazminat davası açabilir, ayrımcılık söz konusuysa ayrımcılık tazminatı isteyebilir. Eylem aynı zamanda hakaret veya tehdit gibi suç oluşturuyorsa savcılığa şikâyet mümkündür.
İşverenin Sorumluluğu
İşveren, mobbingi bizzat uygulamasa dahi önlemekle yükümlüdür; bildiği veya bilmesi gerektiği hâlde gerekli tedbirleri almayan işveren hukuken sorumlu olur.

Mobbing refers to systematically repeated conduct of intimidation, exclusion, humiliation and pressure directed at an employee in the workplace. Article 417 of the Turkish Code of Obligations imposes on the employer a duty to protect the personality of the employee and to prevent psychological harassment in the workplace.
What Conduct Constitutes Mobbing?
Conduct carried out continuously and systematically may be regarded as mobbing, including: assigning tasks outside the job description or unskilled work, unjustified and persistent criticism of performance, isolating the employee from colleagues, insults and demeaning behavior, and the continual and arbitrary reassignment of the place of work. One-off disputes, or practices falling within the employer's ordinary right of management, do not constitute mobbing; the elements of continuity and intent are required.
Proving Mobbing
Proof is the most critical stage in mobbing cases. Emails and records of correspondence, reassignment notices, witness statements, physician and psychologist reports, and official records may be used as evidence. The Court of Cassation accepts that conclusive evidence is not required for mobbing claims and that indicative evidence may suffice.
The Employee's Rights
An employee subjected to mobbing may terminate the employment contract for just cause under Article 24 of the Labor Law and claim severance pay, may bring an action for non-pecuniary damages and, where the conditions are met, for pecuniary damages, and may claim discrimination compensation where discrimination is involved. Where the conduct also constitutes an offense such as insult or threat, a criminal complaint may be filed with the public prosecutor's office.
The Employer's Liability
The employer is under a duty to prevent mobbing even where it does not itself engage in such conduct; an employer that fails to take the necessary measures despite knowing, or being required to know, of the situation is legally liable.
