Sosyal medya platformlarında yapılan paylaşımlar, yorumlar ve mesajlar hakaret suçunu oluşturabilir. TCK m.125 uyarınca hakaret; bir kimseye onur, şeref ve saygınlığını rencide edebilecek somut bir fiil veya olgu isnat etmek ya da sövmek suretiyle saldırıda bulunmaktır.

Sosyal Medya Paylaşımlarının Niteliği

Hakaretin sosyal medya üzerinden “alenen” işlenmesi cezayı artıran nitelikli hâldir. Herkese açık paylaşımlar, yorumlar ve hikâyeler aleniyet unsuru kapsamında değerlendirilir. Özel mesaj (DM) yoluyla yapılan hakaret de suç oluşturur; ancak aleniyet unsuru gerçekleşmez.

Eleştiri ile Hakaret Ayrımı

Ağır eleştiri, rahatsız edici düşünce açıklamaları ve kaba ifadeler ifade özgürlüğü kapsamında kalabilir; suçun oluşması için ifadenin kişinin onur ve saygınlığını rencide edici nitelikte olması gerekir. Yargı kararları bu ayrımı her somut olayda ayrıca değerlendirmektedir.

Manevi Tazminat

Hakaret nedeniyle kişilik hakları zedelenen kişi, ceza sürecinden bağımsız olarak manevi tazminat davası da açabilir.

Posts, comments and messages made on social media platforms may constitute the offence of defamation. Under Article 125 of the Turkish Penal Code (TPC), defamation is an attack on a person by attributing to them a concrete act or fact capable of impugning their honour, dignity and reputation, or by way of insult.

The Nature of Social Media Posts

Committing defamation “publicly” through social media is an aggravating circumstance that increases the penalty. Publicly accessible posts, comments and stories are assessed within the scope of the element of publicity. Defamation committed by way of a private message (DM) also constitutes an offence; however, the element of publicity is not present.

The Distinction Between Criticism and Defamation

Harsh criticism, disturbing expressions of opinion and crude statements may fall within the scope of freedom of expression; for the offence to arise, the statement must be of a nature that impugns the person’s honour and reputation. Judicial decisions assess this distinction separately in each specific case.

Non-Pecuniary Compensation

A person whose personal rights are harmed as a result of defamation may also bring an action for non-pecuniary compensation, independently of the criminal proceedings.
