Ayıplı Malda Tüketicinin Seçimlik Hakları
Satın alınan malın ayıplı çıkması hâlinde tüketici; sözleşmeden dönerek bedel iadesi, ayıp oranında bedel indirimi, ücretsiz onarım veya malın ayıpsız misliyle değiştirilmesini talep edebilir. Satıcı, tüketicinin tercih ettiği bu seçimlik hakkı yerine getirmekle yükümlüdür.
Tüketici Hakem Heyetine Başvuru
Her yıl yeniden belirlenen parasal sınırın altındaki uyuşmazlıklarda tüketici hakem heyetine başvuru zorunludur. Başvuru; e-Devlet üzerinden, ilgili kaymakamlık veya ticaret il müdürlüklerine yapılabilir ve ücretsizdir. Hakem heyeti kararları tarafları bağlar; karara karşı tüketici mahkemesinde itiraz yolu açıktır.
Tüketici Mahkemesinde Dava
Parasal sınırın üzerindeki uyuşmazlıklarda tüketici mahkemesinde dava açılır. Tüketici davaları harçtan muaf olup, dava açmadan önce arabuluculuğa başvuru zorunluluğu bulunmaktadır.
Zamanaşımı
Ayıplı maldan sorumluluk, kural olarak teslim tarihinden itibaren 2 yıllık zamanaşımına tabidir; ayıp ağır kusur veya hile ile gizlenmişse satıcı bu süreden yararlanamaz.

The Consumer's Optional Remedies for Defective Goods
