Vasiyetname, kişinin ölümünden sonra malvarlığının akıbetini belirlemesine imkân tanıyan tek taraflı bir ölüme bağlı tasarruftur. Geçerli bir vasiyetname düzenlenmesi kadar, hukuka aykırı vasiyetnamelere karşı başvuru yolları da büyük önem taşır.

Vasiyetname Türleri

Türk Medeni Kanunu üç tür vasiyetname öngörür: resmî vasiyetname (noter veya sulh hâkimi önünde, iki tanık katılımıyla), el yazılı vasiyetname (başından sonuna kadar vasiyetçinin el yazısıyla yazılmış, tarih ve imza içeren) ve istisnai hâllere özgü sözlü vasiyet. Uygulamada en güvenli yöntem resmî vasiyetnamedir.

Vasiyetname Düzenleme Ehliyeti

Vasiyetname düzenleyebilmek için ayırt etme gücüne sahip olmak ve 15 yaşını doldurmuş olmak gerekir.

Saklı Pay Kuralı

Vasiyetçi, malvarlığı üzerinde dilediği gibi tasarruf edemez; altsoyun, ana-babanın ve sağ kalan eşin kanunla korunan saklı payları vardır. Saklı payları ihlal eden tasarruflara karşı mirasçılar tenkis davası açabilir.

Vasiyetnamenin İptali Sebepleri

Vasiyetname; vasiyetçinin ehliyetsizliği, iradesinin yanılma, aldatma, korkutma veya zorlama ile sakatlanması, içeriğinin hukuka veya ahlaka aykırı olması ya da kanunda öngörülen şekil şartlarına uyulmaması hâllerinde iptal edilebilir.

Vasiyetnamenin hem düzenlenmesi hem de iptali aşamasında yapılacak usul hataları geri dönülmez sonuçlar doğurur; her iki süreçte de avukat desteği alınması önemle tavsiye edilir.

A will is a unilateral disposition mortis causa that enables a person to determine the fate of his or her estate after death. Just as making a valid will is important, so too are the legal remedies available against wills that are contrary to law.

Types of Wills

The Turkish Civil Code provides for three types of wills: the official will (executed before a notary or a civil court of peace judge, with the participation of two witnesses), the holograph will (written from beginning to end in the testator's own hand and containing a date and signature), and the oral will reserved for exceptional circumstances. In practice, the safest method is the official will.

Capacity to Make a Will

To make a will, a person must have the capacity of discernment and must have completed 15 years of age.

The Reserved-Portion Rule

The testator may not dispose of the estate entirely as he or she wishes; the descendants, the parents, and the surviving spouse have reserved portions protected by law. Heirs may bring an action for abatement against dispositions that infringe these reserved portions.

Grounds for Annulment of a Will

A will may be annulled where the testator lacked capacity, where his or her will was vitiated by mistake, fraud, duress, or coercion, where its content is contrary to law or morality, or where the formal requirements prescribed by law were not observed.

Conclusion

Procedural errors committed during both the making and the annulment of a will may lead to irreversible consequences; obtaining the assistance of a lawyer in both processes is strongly recommended.
