Boşanma veya ayrılık hâlinde müşterek çocukların velayetinin hangi ebeveyne verileceği, aile hukukunun en hassas konularından biridir. Türk hukukunda velayete ilişkin tüm kararlarda temel ölçüt “çocuğun üstün yararı” ilkesidir.

Velayet Belirlenirken Dikkate Alınan Kriterler

Mahkeme; çocuğun yaşı, ebeveynlerle kurduğu duygusal bağ, anne ve babanın çocuğa sunabileceği bakım ve eğitim imkânları, yaşam koşulları ve ahlaki durumları ile kardeşlerin birlikte büyümesi ilkesini gözetir. Küçük yaştaki çocukların anne bakımına muhtaç olduğu kabulü yerleşik içtihat olmakla birlikte, her dosya kendi şartları içinde değerlendirilir.

Çocuğun Görüşünün Alınması

İdrak çağındaki çocukların velayet konusundaki görüşleri, uzman pedagog eşliğinde alınır ve karar verilirken dikkate alınır. Birleşmiş Milletler Çocuk Hakları Sözleşmesi de bu yükümlülüğü öngörmektedir.

Velayetin Değiştirilmesi

Velayet kararı kesin hüküm niteliğinde değildir; koşulların değişmesi hâlinde her zaman velayetin değiştirilmesi davası açılabilir. Velayeti elinde bulunduran ebeveynin çocuğun bakımını ihmal etmesi, kişisel ilişkiyi engellemesi veya çocuğun menfaatinin gerektirdiği diğer hâllerde velayet diğer ebeveyne verilebilir.

Kişisel İlişki (Görüş) Hakkı

Velayet kendisine verilmeyen ebeveyn ile çocuk arasında, çocuğun gelişimine uygun bir kişisel ilişki düzeni kurulur. Kurulan kişisel ilişkinin engellenmesi, velayetin değiştirilmesi sebebi olabileceği gibi icra yoluyla da çocuk teslimi süreci işletilebilir.

Ortak Velayet Mümkün mü?

Yargıtay içtihatları doğrultusunda, tarafların anlaşması ve çocuğun yararına uygun olması hâlinde ortak velayete hükmedilmesi mümkün hâle gelmiştir; ancak uygulamada her dosya için ayrı değerlendirme yapılmaktadır.

Velayet davaları, çocuğun geleceğini doğrudan etkileyen davalardır; sürecin pedagojik raporlar ve doğru delillerle desteklenmesi büyük önem taşır.

In the event of divorce or separation, deciding which parent will be granted custody of the couple's children is one of the most sensitive matters in family law. Under Turkish law, the fundamental criterion in every decision concerning custody is the principle of the “best interests of the child.”

Criteria Considered in Determining Custody

The court takes into account the child's age, the emotional bond established with each parent, the care and educational opportunities each parent can provide, their living conditions and moral standing, as well as the principle of keeping siblings together. Although the presumption that young children need the care of their mother is settled case-law, each case is assessed on its own particular circumstances.

Obtaining the Child's Opinion

The opinions of children who have reached the age of discernment regarding custody are obtained in the presence of an expert pedagogue and taken into consideration when reaching a decision. The United Nations Convention on the Rights of the Child likewise imposes this obligation.

Modification of Custody

A custody decision does not constitute a final and binding judgment; where circumstances change, an action for the modification of custody may be brought at any time. Where the parent holding custody neglects the child's care, obstructs personal contact, or in other cases required by the child's interests, custody may be transferred to the other parent.

The Right of Personal Contact (Visitation)

An arrangement for personal contact appropriate to the child's development is established between the child and the parent who has not been granted custody. Obstructing the established personal contact may not only constitute grounds for the modification of custody but may also trigger the process of surrendering the child through enforcement proceedings.

Is Joint Custody Possible?

In line with the case-law of the Court of Cassation, awarding joint custody has become possible where the parties agree and it serves the best interests of the child; however, in practice a separate assessment is made for each case.

Custody proceedings directly affect the child's future; supporting the process with pedagogical reports and sound evidence is of great importance.
