Yabancı bir ülke mahkemesince verilen kararların Türkiye'de hüküm doğurabilmesi için tanıma veya tenfiz davası açılması gerekir. Bu konu özellikle yurt dışında boşanan vatandaşlar ve uluslararası ticari uyuşmazlıklar bakımından büyük önem taşır.

Tanıma ve Tenfiz Ayrımı

Tanıma, yabancı mahkeme kararının Türkiye'de kesin hüküm ve kesin delil etkisi kazanmasını sağlar; boşanma gibi inşai kararlarda tanıma yeterlidir. Tenfiz ise icra edilebilirlik gerektiren kararlar (tazminat, nafaka, alacak) için zorunludur; tenfiz kararıyla yabancı ilam Türkiye'de cebri icraya konu edilebilir.

Tenfiz Şartları (MÖHUK m.54)

Tenfiz için; Türkiye ile kararın verildiği devlet arasında karşılıklılık (mütekabiliyet) bulunması, kararın Türk mahkemelerinin münhasır yetkisine giren bir konuda verilmemiş olması, kararın Türk kamu düzenine açıkça aykırı olmaması ve davalının savunma hakkına uyulmuş olması gerekir. Mahkeme, yabancı kararın esasını yeniden inceleyemez (revizyon yasağı).

Gerekli Belgeler

Yabancı mahkeme kararının aslı veya onaylı örneği, kararın kesinleştiğini gösteren şerh veya belge, apostil tasdiki ve yeminli tercüman onaylı Türkçe çevirisi dava dosyasına sunulmalıdır.

Yurt Dışı Boşanmalarda İdari Yol

Yurt dışında verilen boşanma kararları, belirli şartlarla tarafların birlikte başvurusu üzerine nüfus müdürlükleri aracılığıyla da nüfus kütüğüne tescil edilebilir; bu yol dava açılmasına gerek bırakmayabilir. Şartların oluşmadığı hâllerde tanıma davası zorunludur.

Görevli ve Yetkili Mahkeme

Tanıma ve tenfiz davalarında görevli mahkeme kural olarak asliye hukuk mahkemesi, aile hukukuna ilişkin kararlarda aile mahkemesidir.

Sonuç

Tanıma-tenfiz davalarında belge eksiklikleri ve apostil sorunları en sık ret sebepleridir; dosyanın eksiksiz hazırlanması süreci önemli ölçüde hızlandırır.

For judgments rendered by a foreign court to produce legal effects in Türkiye, an action for recognition or enforcement must be filed. This matter is of particular importance for citizens divorced abroad and for international commercial disputes.

The Distinction Between Recognition and Enforcement

Recognition gives a foreign court judgment the effect of res judicata and conclusive evidence in Türkiye; for constitutive judgments such as divorce, recognition is sufficient. Enforcement, on the other hand, is mandatory for judgments requiring executability (compensation, alimony, monetary claims); by virtue of an enforcement decision, a foreign judgment may be made the subject of compulsory execution in Türkiye.

Conditions for Enforcement (Law No. 5718 (MÖHUK), Art. 54)

For enforcement, the following are required: reciprocity between Türkiye and the State in which the judgment was rendered; that the judgment does not concern a matter falling within the exclusive jurisdiction of the Turkish courts; that the judgment is not manifestly contrary to Turkish public policy; and that the defendant's right of defence has been observed. The court may not re-examine the merits of the foreign judgment (prohibition of révision au fond).

Required Documents

The original or a certified copy of the foreign court judgment, an annotation or document showing that the judgment has become final, an apostille certification, and a Turkish translation certified by a sworn translator must be submitted to the case file.

The Administrative Route for Overseas Divorces

Divorce judgments rendered abroad may also, under certain conditions and upon the joint application of the parties, be registered in the civil register through the civil registry offices; this route may obviate the need to file an action. Where the conditions are not met, an action for recognition is mandatory.

Competent Court by Subject-Matter and Venue

In recognition and enforcement actions, the court competent by subject-matter is, as a rule, the civil court of first instance, and, for judgments concerning family law, the family court.

Conclusion

In recognition and enforcement actions, deficiencies in documents and apostille problems are the most frequent grounds for rejection; preparing the file in full considerably expedites the process.
